The Alberta Dual Practice Marketing Compliance Guide

A statute-cited, plain-English guide to marketing your clinic legally under Alberta's dual practice model, before and after it launches in September 2026.

This is written for clinic owners, surgeons, and practice managers in specialties newly eligible for non-Plan surgical services, starting with ophthalmology. If your clinic is thinking about cataract surgery, hip or knee replacement, dermatology, plastic surgery, or another eligible procedure, this guide is for you.

What it answers

  • What section 8.2 actually requires you to tell a patient before you can charge them for a non-Plan service, and in what order.

  • Why most existing clinic marketing, testimonials, before-and-afters, "best in the city" claims, is already against the CPSA advertising standard, regardless of Bill 11.

  • What written consent has to include, and how to build it into a booking flow instead of bolting it on as a form nobody reads.

  • What changed in the penalties: the new fine amounts, the six-year lookback on administrative penalties, and the Minister's power to name a clinic publicly.

  • What is confirmed about the September 2026 launch date, and what is still unconfirmed, so you are not planning around a rumour.

  • Which procedures are actually on the eligible list today, and which are explicitly excluded.

  • How to describe pricing for a non-Plan service without crossing into prohibited claims or time-limited offers.

  • What a compliant private-pay information page looks like, section by section.

  • Where the line is between what a clinic can say in its own advertising and what an agency can say in general educational content.

  • What record-keeping section 8.3 to 8.5 requires, and how that intersects with your booking and billing systems.
